RESERVATION FOR SOCIALLY DISABLED PERSON

when we talk about the sc/st category in our country so there has lots of provision in our constitution for uplifting these minority or backward classes .But here we were discussing about disabled section of our society .so according to WHO report ,about 15% of worlds population lives with some form of disability by birth or due to any accident .due to reason of that disability that person were faces lot of problems in his or her life. many of them are belonging to the poorest section of society as well as many people were come from higher section of society . but they all were facing lot of challenges to access education and getting jobs . if we were talking about them intellectually so no doubt they are brilliant but in our society people don't want to give jobs to a disabled person whether they were belonging rich or middle and poor section of society because many of us think that they are just burden but no one want to uplift them .so in our country our supreme court a decision for disabled section .When we talk about our constitution article 41 stated that state shall make effective provision for security right to work education and employment .

Recently ,during covid 19 supreme court of India decided that "people suffering from disability are also socially backward and  hence they get the same benefit as given to the sc and st candidates".

 in 2012 this matter was pending in the high court
the high court held that differential treatment with sc/st and disabled person by providing them minimum eligibility 5% and 10% respectively .

.reservation were increasing 3% for that persons who were suffering any disability.

some other facts of supreme court decision

1. physical or mental disability with social disability .
2.sometime disabled persons also belong to wealthy families and they use for it for his benefits . But all are not equally enjoy that benefits .
3.disabled persons also faces the same situation in work places or in our society as our sc /st community faces .
4.needed person deserve  this reservation first but it doesn't mean that if a person belong from rich person then he don't deserve this benefit because in our society many disabled person who were belonging rich family they also needed for creating their own self made identity.  

Conclusion

 after the light of the above discussion here we can say that the reservation is needed this pandemic for all those disabled person who were equally socially backward as sc /st classes of our society  and its the responsibility of our government take measures to provide facilities to disabled person especially during this pandemic . Although supreme court decision has a good step .Supreme court also need to make balance between deserving disabled person or need to check and balance between poor disabled person or   financially backward class of  our society.
