Himachal pradesh land revenue act ,1954........classses of revenue officers and their power and function

Introduction: when we  talk about the classes of revenue officers and their powers so its provided under section 7 to 28 of hp land revenue act ,1954. its primary object is to maintain relation between land lord and tenants to prepare the land record to settle the disputes .when we talk about the classes of revenue officers it were provided under section 7 to 11. Financial commissioner cum principle secretary is the revenue minister who also performed the judicial function .

the main objective of this act to maintain relation between land lord and tenant and resolve there disputes.

             classes of revenue officers                               

1. financial cum principal secretary . 
A senior IAS officer as a commissioner control the entire land  revenue of h.p all the revenue officers are under the his  control . 

2.Divisional commissioner : an ias officer senior to collector control the entire administration of the division .
3.Collector   : an ias officer administrative in charge of the entire district .

4.Assistent collector -    an IAS or HAS but junior to dc.

5.SDOcivil--- an HAS officer he enjoy similar there function as DC enjoy in district.

6. AC1-Appointment by the state government administrative incharge of the tehsil.
7.AC11----- Entire administration of the sub tehsil.
8.Kanungo-  it cover 7 to 10 patwari circle .
9.Patwari - it cover 10 to 15 village .

                       POWERS OF REVENUE OFFICERS  AND THEIR FUNCTION

Here above we discussed about the classes of revenue officers now we further are discussion the power and function of revenue officers .Section 11 of H.Pland revenue act 1954 provided its power and function.

1.Power of financial commissioner
.financial commissioner has the power to hear appeals and revision petitions  under section 14 to 17 of the act .
.under section 13 of the act the financial commissioner has the power to distribute business and withdraw and transfer cases from any revenue officer under his control. 
. under sn 34-a  approval of financial commissioner mandatory to divide an estate into or mare estate into one estate during settlement operation on reverence by the collector  .
. under section 67 of the act, the financial commissioner with approval  of the state government may issue executive instruction for the guidance of revenue officers .
. under section 70 of the act , the financial commissioner with may fix the number and amount of the instalment of land revenue by whom to be paid and also the time places and the manner in which it is to be paid.

standing order 2 - general procedure of revenue officers and revenue courts.
standing order 8 - coercive procedure
standing order 12 - business return
                              standing order 13- calendar of settlement  

2.Power of commissioner
.commissioner is empower to hear appeal under section 14 and also power under section 17 of the act to call for any record of any case pending or disposed by any revenue officer under his control and reports the case to the financial commission with his opinion for order of the financial commissioner.
. under section 13 of the act the commissioner has the power to withdraw and transfer cases from any revenue officer under his control in the division.
. under section 16 of the act , the commissioner can review his own order senior can review his own order without permission for financial commissioner . he is empowered to review the order passed by his predecessor with the permission of financial commissioner
 . under section 83 of the act, commissioner has the power to proceed against other immovable property of defaulter .
. section 94 of the act, is required to reduction  of arrear and sale of property etc. 
. under section 95 of the act, the collector shall report  every sale of immovable property under chapter six.

.hear appeal under section 14 of the act against  the order of revenue officer exercising the power of assistant collector of the first and second grade.
. collector is the controlling officer of all the revenue officers in his district as per section 12.
. under section 13 of the act , the collector has the power to distribute business and withdraw or transfer cases from any revenue officer under his control.
. the assistant collector 1st and 2nd grade cant  review the order passed by himself. 
. under section 80 of the act , the collector is empowered to make proclamation of attachment  or annulment of assessment .
. collector has the power to initiate proceeding of recovery against other immovable property of defaulter under section 83 of the act with sanction of the commissioner subject to the condition laid down under this act.
can issue proclamation of sale under section 85 of the act.


POWER OF THE TEHSILDAR AND NAIB TEHSILDAR
. In Himachal Pradesh tehsildar have  been invested with the power of first grade and second grade . naib tehsildar  exercise power of assistant collector second grade.
Naibe tehsildar has all the power of assistant Collector second grade of the act can entertain cases of partitions  under chapter nine and enforcement cases under section 163  of the act , but he cant decide question of tittle involved in any case . The naib tehsildar who is vested with the power of assistant collector
 . The tehsil of revenue officer shall exercise the power  conferred pn the notification  dated 27-7-1985.
